PVE and Miraleste RPV have such a unique bucolic character (supported by PVHA CC&Rs, Bylaws, and Deed Restrictions) that needs to remain protected for the enjoyment and benefit of our PVHA members.

As a Candidate for the 2024 PVHA Board of Directors, I pledge to serve PVHA members and work collaboratively with PVHA members, the PVHA Board, and the PVE City Council to:

1)   Promote local control of Land Use Decisions (versus State mandates)

2)   Protect our CC&Rs, Bylaws, and Deed Restrictions

3)   Improve Community Outreach, Communications, and Operational Efficiency

The State recently approved several new Land Use Bills that mandate increased zoning densities throughout the State, that also supersede some of our PVHA CC&Rs and begin to challenge some of our existing PVHA Deed Restrictions:

a)   ADUs Accessory Dwelling Units (State mandate)

b)   SB9 and SB10 allows zoning density of single family home lots to be increased up to 4 and 10 units, respectively (State mandate)

c)   Housing Element Plan (AB 215) requires Cities to identify lots with increased zoning density that are intended for affordable housing (State mandate)

d) Workforce Housing (AB 2295) allows school site properties to be rezoned to higher density and used primarily for local educational workforce housing purposes (however due to existing Deed Restrictions between the PVHA/PVUSD, approvals are also required by: the majority of the PVE School District Board; a majority of PVHA  living within 300 feet of any potential affected area; and a majority of the PVHA Board)

  1. Promote Retention of Local Land Use (Support a Statewide ballot to overturn several recently approved State Land Use mandates)

“Counties, Cities, and Home Associations located throughout the State are banding together with “Our Neighborhood Voices” to support a Statewide initiative being placed on the ballot in 2024 (or 2026) to overturn these and other State mandates aimed at building low-income high-density housing developments in our existing neighborhoods”

2. Protect PVHA CC&Rs, Bylaws, and Deed Restrictions

PVHA CC&Rs, together with the underlying Bylaws and Deed Restrictions, apply to all PVE and Miraleste property owners.

a) CC&Rs (Covenants, Conditions, and Restrictions) are contractual agreements that establish rules, restrictions, and obligations for property owners. They aim to protect property values and the rights and interests of homeowners.

b) Bylaws dictate how a Homeowners Association should run in order to to govern the day-to-day operations.

c) Deed Restrictions (sometimes referred to as Restrictive Covenants) are agreements that limit or prohibit certain activities typically involving the property use, maintenance, and appearance.

3. Improve Community Outreach/ Transparency, Communications and Operating Efficiency

PVHA members would like to see continuous improvement in community outreach, communications, and operating efficiency

Community Outreach/ Transparency improvements by increasing community outreach and greater awareness about the PVHA, including information already residing on the PVHA website and determining if there is any other publicly-held data & information that can be made easily and readily available for PVHA members.

Communication improvements by including balanced reporting using interpersonal communications, emails, websites, and mailers/fliers for PVHA members that don’t use or have access to personal computers or smartphones.

Operating Efficiency improvements to include: Digitization and electronic archiving of PVHA records; Cleaning up the language in our Bylaws that are no longer applicable to the PVHA (i.e., responsibilities and authorities that were transferred long ago from the PVHA to the PVE City) and seek member approval; Providing better insight and understanding of PVHA Art Jury reviews and approvals, together with improved streamlining & synchronization between the PVHA Art Jury and the City; Allocating additional resources to help remedy properties that are not being well maintained or are out of compliance; Promoting the need for greater voter turnout during annual elections, and/or extend the voting period if the quorum has not been met to allow more time for votes to be submitted; Seeking to move the calendar for holding PVHA elections so they do not overlap with the holiday season; and Applying for State and County Grants and seek additional support from community volunteers to help accelerate and fund these and other efficiency improvements.

PVHA elections have not occurred since 2009 due to not meeting the required quorum…Will 2024 be the year for change?

Over the last 24 years, the PVHA has only met a voting quorum for the election 4 times (or only 17% of the time) since 2000!

The last time the PVHA met the required 50% (+1) quorum to validate an election was in 2009.

Although lowering the voting quorum threshold from 50% (+1) to 35% would improve the ability of achieving a quorum, it also raises concerns of having a minority of our members being able to affect the outcome of PVHA elections.

During the 2020 election, PVHA members were offered the opportunity to vote for reducing the quorum going forward to 35%, but unfortunately a quorum was again not met…and only 1,229 (or 23%) of PVHA total members casted an advisory vote in favor of reducing the quorum.

Let 2024 be the year that we reach the 50% (+1) voting quorum, so that the PVHA Board is elected by the majority of PVHA members!

    • Last day for ballots to be received by the Election Official (NLT 4:30pm PST). RECOMMEND VOTING AS SOON AS POSSIBLE IF VOTING BY MAIL TO ALLOW ENOUGH TIME FOR BALLOTS TO BE RECEIVED.

    • PVHA Voter Help Desk closes

  • Jan 9th (Annual Meeting)

    • Ballots are tabulated (if a quorum is reached)

    • Results announced

2024 PVHA Board of Directors - Election Results

Total votes cast: 1,204 (22% of total members)

Total votes required to meet the required quorum: 2,011 (50% +1 of total members)

Since a quorum was not achieved, per PVHA Bylaws and adopted Resolutions:

- No business was able to be conducted and the ballots were not opened or tallied

- Ballots are to remain sealed and kept by the Director of Elections for 1-year

- Vacancies of the Board shall be filled by the remaining Directors:
